Asbestos Bankruptcy Trust Settlements Department

As of August 1, 2007, the Williams Kherkher Bankruptcy Trust Settlements Department has been busy as a bee hive in the Spring. Several trusts to include, ABB Lummus, A.P. Green, Armstrong World Industries, Fibreboard, Owens-Corning, and U.S. Gypsum, became effective in 2007. Each of the foregoing trusts began to officially accept the submissions of asbestos-injury related claims by paper and/or electronically.

Given the fact that the Attorneys at Williams Kherkher represent thousands of clients with asbestos-related injuries; we have thousands of asbestos-injury related claims to submit to various trusts. Each TDP or Trust Distribution Procedure requires that each asbestos-injury related claim be submitted to each specific trust with enough background information (questionnaire) and supporting documentation (medical records, work/exposure history, and legal documents) to fulfill the basic requirements of the trust. Although, the Williams Kherkher Bankruptcy Trust Settlements Department processes thousands of claims annually, the submissions department is actually a small unit of highly skilled and well trained personnel. Williams Kherkher as a leader in the asbestos community always wants to be at the forefront and continues to lead the way. Williams Kherkher has taken steps to further multiply the number of asbestos-injury related claims being processed.

The firm has entered into Electronic Filing Agreements or EFAs with each of the viable trusts to electronically file asbestos-injury related claims. The move toward filing electronic submissions instead of the paper format has allowed the firm the opportunity to submit vast numbers of claims in a more effective and efficient manner. Since Williams Kherkher now submits claims electronically, thousands of claims will be submitted at any given time (i.e., monthly). Electronic filing not only allows for the timely filing of asbestos-injury related claims with trusts, but also creates opportunities for trusts to make expedited offers of settlement to our clients.
