Two Workers Lost Due to Mesothelioma

The estate of Richard Kelley has filed a mesothelioma lawsuit against 13 corporations after suffering asbestos exposure that eventually lead to the development of pleural mesothelioma. According to the lawsuit, Kelley worked as a personnel and plant manager from 1958 to 1991. He was not diagnosed until moments before his death on September 15, 2005. Mesothelioma can be very difficult to diagnose because symptoms often do not appear until the cancer has fully developed. Kelley's estate is claiming that the 13 corporations were negligent for their use of asbestos. The estate of another worker, Wilfred Korando, has also filed a mesothelioma lawsuit. Korando was employed from 1954 to 2004 as a mechanic, washer and dryer maintenance man, and commercial window installer. Diagnosed with maligant mesothelioma, Korando passed away on January 21, 2007. Defendants in his case include some big name brands, such as Chrysler, Ford Motor Company, Boeing, General Electric, Goodyear, Maytag, MetLife, Rolls-Royce, and Whirlpool, among others. His estate claims that the defedants caused Korando's mesothelioma due to the use of asbestos in their products. New Mesothelioma Lawsuit Filed

When inhaled or ingested, asbestos causes serious damage to the lungs and other internal organs over time. A mesothelioma lawsuit was filed by Thomas Sowers. Recently diagnosed with a cancer of the lungs, mesothelioma, Sowers has listed nine defendant corporations in the lawsuit. He claims that he was exposed to asbestos during his time working for these corporations or through his work with their products. Sowers was employeed by the U.S. Navy from 1967 tp 1973, during which time he worked as a machinist and in the boiler and engine rooms. Then from 1973 to 1983, he worked as a laborer for Stone & Webster Engineering Corporation. After that job, he became a supervisor at Virginia Electronic & Power from 1983 to 2003. Unfortunately for Sowers, all three occupations are known for their risk of asbestos exposure. The lawsuit states that the asbestos exposure could have been avoided if he was provided the proper safety equipment. It also states that the defendants should have been able to anticipate the dangers of their work place. Sowers and his wife are seeking compensation of close to $250,000. Toronto Explosion Raises Mesothelioma Risk

An unexpected explosion at the Sunrise Propane facility in Toronto, Canada, has left nearby residents in shock and at risk of mesothelioma. The blast has caused extensive damage to some nearby homes,  causing residents to evacuate after toxic levels of asbestos had been found in the neighborhood. The houses that were damaged released asbestos fibers into the air, putting anyone in the area at risk of ingesting or inhaling the dangerous substance. Illinois Man Files Mesothelioma Lawsuit

Illinois resident, William Kirk, was recently diagnosed with mesothelioma in June. Kirk worked as a truck driver, laborer, and mechanic for various employers for 68 years, ranging from 1940 to 2008. He lists 89 defendants, including: Chrysler LLC, DuPont Chemical, CBS Corp., General Electric, and Honeywell. According to the lawsuit, Kirk claims to have been exposed to asbestos fibers that were emitted from the products that he worked with and around during his 68 year working history. Kirk claims in his lawsuit that the defendants were or should have been aware that the products contained dangerous asbestos fibers. He notes that his employers and the manufacturers of the products did nothing to warn him of the dangers. The lawsuit also alleges that the insurance company of Metropolitan Life Insurance Co. withheld information and misrepresented the danger of asbestos exposure, which ultimately lead to Kirk's development of mesothelioma. Your Potential Asbestos Exposures after a Natural Disaster

Your favorite news channel informs you of an impending natural disaster, i.e., flood, tornado, storm, tropical storm, or hurricane. You have decided to stay and ride out the storm because you are well prepared. You have canned goods, flashlights, batteries, candles, plenty of water, and maybe even a generator or two (in the event of a loss of power). Moreover, you are mentally prepared, your family is prepared, and everything should be alright. You were right; you and your family safely weathered another storm, but your home, your neighbors’ homes or your neighborhood received damage. Therefore, you begin the process of assisting with the clean up and repair of your home, your neighbors’ homes or your neighborhood. Be careful; there may be asbestos-containing materials hidden in the construction debris and any attempt to clean up that construction debris may release breathable asbestos fibers into the air. Asbestos-containing products were used in many residential construction materials. Asbestos was widely used in building materials and products for insulation and fire resistance. Any residential structure built before 1975 most likely was constructed with materials that were made with large amounts of asbestos. According to the United States Environmental Protection Agency (USEPA) homes built between 1930 and 1950 were most likely built using asbestos-containing insulation. The USEPA found that many homes were constructed with asbestos-containing materials which included: sprayed on soundproofing; exterior siding; piping or other insulation; artificial ashes and embers; asbestos cement roofing, shingles, and siding; patching, joint compounds and textured paints; door gaskets; cement sheets, millboard, and insulation paper; resilient floor tiles, vinyl sheet flooring, adhesives; and furnace ducts. When disturbed or damaged, or due to deterioration, theses materials become hazardous and pose a great risk to you or your loved ones’ health as they may release high concentrations of airborne asbestos into the air. This disturbance or damage to the asbestos-containing materials can occur during a natural disaster, during demolition, or even during the renovation of your home. During the clean up phase after a natural disaster there are many activities that may disturb or damage the asbestos-containing materials including, dusting, sweeping, vacuuming, sawing, sanding, scraping, or drilling holes. During this phase construction related materials and debris, wood, drywall, asbestos-cement boards, plywood, molding, and piping, may be handled, moved, broken or cut into smaller pieces, thereby releasing the dry or friable asbestos fibers into the air. Sweeping or vacuuming many of the asbestos-containing materials in the debris can also generate asbestos dust. When the asbestos-containing construction materials are damage or disturbed, friable asbestos fibers are released into the air and may be inhaled into the lungs. The inhalation of asbestos fibers can cause asbestosis, lung cancer, and mesothelioma. The asbestos fibers embed in the lung tissue and over time can cause lung disease, to include Asbestosis which may cause scarring of the lung tissue, shortness of breath and a crackling sound in the lungs while inhaling; Lung Cancer which may cause carcinoma, anemia, shortness of breath, hoarseness, and chest pain; and Mesothelioma which may cause cancer in the membrane of the lung, chest, abdomen, and heart. Any exposure to asbestos fibers could take up to twenty years to manifest any injury in the exposed person. After a natural disaster and during the clean up phase, working safely must be your goal. You must use the appropriate personal protective equipment (PPE). Your personal protective equipment may include protective eyewear, disposable clothing or a full body jump suit, gloves, and a mask or respirator. Attempt to minimize asbestos fibers and asbestos dust by keeping the damaged construction related materials wet or damp, and double bag the debris. Make sure you wash your hands and clothing while still wearing your mask or respirator. Protect yourself and your family from mesothelioma; be sure to use the PPE while cleaning up asbestos-containing construction related materials and debris after a natural disaster.
