On Sept 28, 2008 Virginia Schmidt of California filed an asbestos suit in Madison County Circuit Court stating that her husband Oswald Schmidt had contracted mesothelioma, a disease that was wrongfully caused. Oswald was diagnosed with mesothelioma on December 12, 2007 and died from the disease a few months later. The suit claims that Oswald’s disease was caused when he was exposed to asbestos at work. From 1949 to 1989 Oswald worked as a welder at various locations throughout Illinois and Kansas.
The suit claims that the disease was caused as Oswald was exposed to, inhaled or ingested asbestos fibre from the products made, sold or serviced by the defendant companies. In an 11 count lawsuit she is seeking compensatory damages in excess of $200,000 and other relief for the mental and physical pain suffered by Oswald before his death.
