Insurers Must Pay for Asbestos Suits

The Wisconsin Supreme Court has recently given a ruling that makes insurers responsible for asbestos and mesothelioma suits against companies. This comes in reaction to the case between Plastics Engineering Company, or Plenco, and Liberty Mutual Group. Insurance carrier Liberty Mutual tried to get out of paying out for these suits based on limited coverage plans.

Between 1950 and 1983, Plenco exposed many people to asbestos, leading to mesothelioma and other asbestos related diseases. Liberty Mutual, Plenco's insurance carrier since the 1960s, claimed that they had paid as much as the coverage provided for. However, the Supreme Court decided that was not the case. Liberty Mutual is still responsible for all mesothelioma suits against Plenco.

Monk Dies of Mesothelioma

A New York man living as a monk in the UK died of mesothelioma recently at the age of 86. As a young man, he served as a pilot during World War II and received his education at Harvard. He was very active in the Catholic Church, and eventually moved to Caldey Island in the UK to pursue a life as a monk. There, he lived and worked at the monastery for several years.

When he was diagnosed with mesothelioma, it was unknown where he might have come into contact with asbestos. While there are many possibilities, he may not have been aware of the asbestos. It is possible that his time in the military exposed him to asbestos, or perhaps he was exposed at any other point in his life. It is impossible to tell at this point.

School Closed for Asbestos

Wee Disciples Christian Enrichment Program in Charles Town has been closed down since January 15th when asbestos was found. Everything in the school is considered contaminated by the asbestos, and the more than 200 pre school through 1st grade students have been out of school for two weeks. The school is hoping to use a new facility in the near future.

Asbestos is a very dangerous substance that can lead to terrible diseases and medical conditions such as asbestosis and mesothelioma. Unfortunately, the latency period between exposure to asbestos and the time that symptoms begin to show can be as long as thirty to fifty years. The prognosis for these conditions are rarely good because of this latency period.

$200,000 Penalty for Mishandling Asbestos

Union Pacific Railroad based out of Omaha has agreed to a settlement of $200,000 over their mishandling of asbestos a few years ago. The company removed 13 metal sheds from a rail line in 2005. These sheds were sent to Western Metals Recycling in Salt Lake City for shredding, but asbestos was found after the first 12 were destroyed.

The 123 square feet of asbestos found in the thirteenth shed had to be properly disposed of and an investigation had to be initiated. Luckily, no one was harmed in the ordeal. However, asbestos exposure can begin to manifest as a disease or medical condition up to fifty years after the actual exposure. Mesothelioma, a terrible form of cancer, is one of the largest risks in asbestos exposure.

Mesothelioma Case Appealed

A large victory on the mesothelioma front in the UK was appealed by the company involved. The Fibrecrete asbestos company operated for the 40 years before 1971, exposing many people to the extremely dangerous substance, asbestos. When the court ruled in favor of the former employees and their families, the company appealed. Now the case will wait for another year before anyone knows about compensation.

Nearly 40 years after the company closed down, employees are beginning to see the signs of asbestos related conditions. However,  the attorney on this case believes that mesothelioma related to this particular company will not reach its peak until 2015. Until then, the large number of people with mesothelioma will only grow in size.
