Jury Awards First Mesothelioma Punitive Damages in New York State in 20 Years

A jury in New York State awarded the family of a man who died of mesothelioma $1.5 million in damages and an additional $750,000 in punitive damages.  The man came into regular contact with asbestos, a primary cause of mesothelioma, during his 18-year career at Hooker Chemical in Buffalo from 1970 to 1988.  He worked overhauling valves which contained asbestos components and packing.  The asbestos parts were supplied by Fisher Controls of Iowa, which had known of the dangers of asbestos since at least 1946 but had continued to produce hazardous products.

Punitive damages are damages which are applied in an effort to deter the defendant and other parties from breaking the law.  This is the first time in 20 years that a mesothelioma case in New York State has involved such damages.

Widows Receive $5.5 Million in Mesothelioma Lawsuit

Three Bloomington, Illinois widows have received a jury award of $5.5 million in a lawsuit alleging that their husbands died of mesothelioma as a result of working in factory conditions which exposed them to asbestos.  The men worked at UNARCO in the '50s and '60s, and died as a result of mesothelioma, which they had developed working at the factory.  The jury found that UNARCO and other companies had failed to warn their employees about the dangers of asbestos, which had directly affected the contraction of the disease.  The lawsuit further alleges that the companies agreed not to warn their employees about the dangers they faced.

Owner of Amarillo Abestos Removal Company Indicted

The owner and operator of Asbestos Maintenance Services, a firm specializing in asbestos removal in Amarillo, Texas, has been indicted on federal charges of improperly disposing asbestos.  Asbestos is a dangerous carcinogen, and allowing the fiber to get into the air is a violation of federal laws governing its disposal.

According to court documents, the man had safely disposed of the material for years by taking it to a licensed landfill.  However, by July of 2006, he had become delinquent in his payments to the landfill, and began to dispose of the asbestos in a residential area on the outskirts of town.  He is currently being charged with two counts of the knowing release of a hazardous air pollutant and two counts of \violating waste disposal standards for asbestos.

In Indiana, Victims of Mesothelioma Demand Law Change
