The judge overseeing the Texas
Multidistrict Asbestos Litigation on Monday ruled to allow the expert testimony
of Dr. Ron Gordon in the case of Torres, et al. v. Union Carbide Corp., et
al. By doing so, Judge Mark Davidson denied the defense's motion to
strike the testimony in an asbestos case being tried by Williams Kherkher
attorneys Troy D. Chandler and Devin McNulty.
Counsel for defending firm Garlock
claimed that the testimony of William Kherkher's expert witness had serious
flaws. According to Garlock’s lawyers, Dr. Gordon's testing of both lung
and pleural tissue for the presence of asbestos was not an accepted technique.
However, Judge Davidson ruled that the testimony was admissible in court. The
positive ruling seems to confirm that the Williams Kherkher attorneys are
correct in their assertion that the defendant's product "contained 85
percent crocidolite asbestos fiber, was accompanied by no warnings, released
respirable asbestos fibers, and will be a proximate cause in the death of Oscar
Torres."
Furthermore, the attorneys assert
that Garlock's questioning of the testimony is tantamount to questioning the
very basis of mesothelioma testing, a method widely accepted within the medical
community.
