Japanese Man Dies of Asbestos-Related Lung Cancer; Family Seeks Damages

A family from Osaka, Japan is suing Kansai Hochiki Engineering, a fire protection equipment dealer for allegedly exposing their family member to asbestos on the job.

The family claims that the company failed to adequately protect their employee. They are accusing the company of neglecting the vicitm's safety when they allowed him to work in small confined spaces with little venilation where asbestos was present. Exposure to asbestos can lead to lung cancer, asbestosis and a rare form of cancer, mesothelioma. 

 The victim was diagnosed with lung cancer caused by asbestos in 2005.

Mesothelioma Cases Still on the Rise

Despite the increased awareness of the danger of asbestos and mesothelioma over the past two decades, the number of cases of the virulent form of cancer is still on the rise.  The number of mortalities due to mesothelioma has increased over the past decade, and there is no reason to believe that this trend will reverse.

According to research compiled by the National Institute of Occupational Safety and Health, the number of deaths due to malignant mesothelioma continues to increase.  Although the use of asbestos was curtailed in the late 1970s, approximately 1.3 million workers are still exposed to asbestos dust.

London company fined for asbestos failings

A London company was fined for not carrying out proper risk assesments for the presence of asbestos before an office refurbishment.

The employees and contractors were put at risk when starting to do the refurbishment and not checking for asbestos. The company pleaded guilty and was fined. Officials say that the company was required to have comprehensive asbestos management in place to check for asbestos in the locations but they failed to do this.

Two construction sites being investigated for presence of asbestos

The state Department of Environmental Protection is investigating two construction dump sites for the presence of asbestos in materials in Lee County.

Since July, the DEP has removed 2,800 tons of fill material containing asbestos. This information went out to the public on Thursday.

One of the companies has paid a $6,500 fine and since January 2008, has paid 1,220 feet of asbestos discovered at one of the sites. The DEP is still investigating and is no placing blame yet. They were using the material to widen a road.
