The Asbestos Hazard Emergency Response Act
AHERA was passed in 1986 to protect students from asbestos exposure in public schools. Under this Act, all public schools and nonprofit private schools to develop and follow an asbestos management plan. This involves:
- Assessing the asbestos level of each building on campus
- Ensuring all asbestos is safely intact or removed
- Regularly re-assessing the campus for safety
Asbestos only becomes dangerous when it is disturbed or allowed to deteriorate, causing fibers to come loose and possibly be inhaled. For this reason, schools are not necessarily required to remove all asbestos from their campuses. However, they do have to make sure that any asbestos in their insulation, ceiling tiles, or wall board is safely sealed and intact.
