			<content:encoded><![CDATA[<p>An asbestos lawsuit filed on May 5 by six former plaintiffs that claim that they were exposed to asbestos and other toxic materials when working on an Oak Ridge Cleanup in 2000 and 2001.</p>
<p>The plaintiffs filed the lawsuit against multiple government contractors after stating that they were negligent in exposing workers to asbestos and other hazardous material when the worked on the Department of Energy&#8217;s K-25 Plant cleanup project.</p>
<p>The project worked to decontaminate and dismantle three facilities at the Oak Ridge site that were enriched with uranium. The plaintiffs were told that the condensers that they were using did not contain asbestos, but they claim that they were exposed to asbestos while they used chop saws to cut equipment.</p>
<p>They also claim that they were denied the use of respirators and other gear that would protect them from the dust particles. Representation for the men claim that they have each experienced medical problems as a result of being exposed to the toxic material.</p>

			<content:encoded><![CDATA[<p>Earlier this week, the state overturned a decision regarding an asbestos lawsuit that was first decided in June 2010. The lawsuit claimed that the makers of a brake grinding machine were negligent in causing mechanics to develop asbestos-related diseases.</p>
<p>The lawsuits claim that the brake shoe grinding machines released asbestos as a result of grinding the brake&#8217;s linings. The lawsuits were filed by a mechanic that developed asbestosis and three families that lost loved ones due to an asbestos-related disease in 2007 and 2008.</p>
<p>The machine&#8217;s maker, Hennessy Industries, claimed that they were  not at fault because their machine did not use asbestos. The decision was recently overturned when it was discovered that asbestos is emitted as a result of grinding brake&#8217;s linings.</p>

<p>The firehouse currently houses Ladder 15 and Medic Unit 47 and is located in Frankfort. Asbestos material is a known carcinogen that becomes a hazard when it is disturbed because it can lodge within the lining of the lung.</p>

			<content:encoded><![CDATA[<p>A mesothelioma victim, who filed an asbestos lawsuit against dozens of companies  claiming that they were negligent in protecting him against harmful asbestos materials, died while in the middle of the deposition process for the lawsuit and never got to make it to his court hearing.</p>
<p>Now, his family is claiming that the defendant&#8217;s attorney used delay tactics so that the mesothelioma victim would die before making it to court. After his death, the compensation that his family can receive was cut by nearly 70 percent. Once an asbestos lawsuit is filed, defendants can have deposition time in order to ask the plaintiff questions.</p>
<p>In California, they can have up to 20 hours to question the plaintiff. Because of the amount of companies in the lawsuit, this mesothelioma victim, John Johnson, had 25 hours to complete even though his doctor stated that in  his condition, he could handle no more than 12.</p>
<p>On Jan. 23, the 69-year-old Johnson, could barely catch his breathe while he answered dozens of questions from defendant&#8217;s attorneys. Forty minutes after the deposition, he passed out and was taken to the hospital where he died the next day. Officials are now wondering if there is a better way to handle asbestos law so tragic cases like Johnson&#8217;s, do not occur.</p>

<p>This is the second time asbestos has been found in this space, which has lead investigators to question how the carcinogen returned to the area. Officials have stated that workers will be working 10 hour shifts in order to remove all of the asbestos from reference materials.</p>
<p>Multiple other locations have also undergone asbestos cleanup processes, including the basement of the courthouse which will now be reopened shortly. The cost of the entire cleanup process is unknown at this time because the project costs have gone up due to delays.</p>

<p>Officials with the company that manage the pipe have said that is may take anywhere between a week to 10 days. The cleaning process has taken the crew longer than expected because the test results came back that asbestos was still in the air.</p>
<p>After the first results came back, the cleaning crew  had to power wash the whole area again and are currently cleaning the buildings, streets and balconies on 11th Street. Convention Plaza has already reopened, but the area near Lucas Avenue remains closed at this time.</p>

<p>According to on-site workers, the asbestos was found underneath the building that was being removed to make room for the library. The building used to be school and the officials believe that the debris is leftover from this original structure.</p>
<p>The additional materials needed for the removal will be close to $1.3 million. The overall cost of the project is estimated to be $49.5 million, but this should not go much higher because city officials make sure to add in additional costs when creating a budget. The library is set to open in 2013.</p>

			<content:encoded><![CDATA[<p>Regulators with the Department of Energy have stated that the use of heavy machinery when removing asbestos-containing materials has been restricted during demolition projects out of the concern of those working.</p>
<p>The agreement was recently signed after the inspector general for the Environmental Protection Agency stated that the removal of asbestos at a Hanford building may have put workers at risk.</p>
<p>Asbestos used to be removed by hand, but sometimes heavy machinery is used to remove the paneling from buildings. This was always thought to be a safe way, but it has now been seen that the asbestos fibers  may crumble, which makes the fine enough to be inhaled.</p>
