Legal Challenges Facing Mesothelioma Victims
December 2008 saw two decisions by the Washington State Supreme Court that should give pause to many. In the cases Braaten v. Saberhagen Holdings and Simonetta v. Viad Corp., the Court ruled 6-3 in favor of the Defendants. At issue in these lawsuits was whether the manufacturers involved had a legal obligation to warn about risks associated with using their products.
In each case, the Plaintiff worked with the asbestos-containing product in the course of his job and developed an illness attributable to the mineral. Braaten developed mesothelioma and Simonetta was stricken with lung cancer. The individual parts that had asbestos did not originate with the manufacturers, but the manufacturers knew that the substance was present and posed a health risk. Despite this, they did not warn that it may be incredibly harmful, and the Washington State Supreme Court ruled that such a warning was not required.
This is contrary to precedent set in a number of other cases, and the decision will likely be appealed.
